Immigration and Work Permits

In General —
Effective January 1, 2021, the U.K. has introduced a points-based immigration system that treats EU and non-EU citizens equally.
Any foreign national from outside the U.K., excluding Irish citizens, must apply for permission in advance.
Under the points-based system, foreign nationals must meet a specific set of requirements for which they will score points.
Those who gain enough points will receive a visa. Employers must have a sponsor licence to hire most workers from outside the U.K.

自 2021 年 1 月 1 日起，英國引入積分制移民制度，平等對待歐盟和非歐盟公民。
來自英國以外的任何外國國民，除了愛爾蘭公民，必須提前申請許可。
在基於積分的系統下，外國公民必須滿足一組特定的要求才能獲得積分。
那些獲得足夠積分的人將獲得簽證。

雇主必須有擔保人許可證才能從英國以外僱用大多數工人。

Visas and Work Permits —
Skilled Worker Visa.
Under the skilled worker system, foreign nationals coming to the U.K. for work must be able to demonstrate that:
• they have a job offer from a licensed sponsor;
• the job offer is at the required skill level;
• they speak English to the required standard; and
• they have a job offer that meets the minimum salary threshold (which is the higher of either 25,600 pounds or the specific salary requirement for their occupation, known as the “going rate”).
Applicants may trade characteristics, such as their qualifications, against a lower salary to get the required number of points.

技術工人簽證。
在技術工人制度下，來英國工作的外國人必須能夠證明：

• 他們有來自有執照的擔保人的工作機會；
• 工作機會有達到要求的技能水平；
• 他們口說英語達到要求的標準； 和

If the offered salary is below the minimum salary requirement but not less than £20,480, an applicant may still be eligible for a visa if they have:
• a job offer in a specific shortage occupation;
• a PhD relevant to the job; or
• a PhD in a STEM subject relevant to the job.

如果提供的薪水低於最低薪水要求但不少於 20,480 英鎊，如果申請人符合以下條件，則仍有資格獲得簽證：

There is a fast-track entry system for doctors, nurses and other healthcare professionals.
Global Talent Visa.
Effective Jan. 1, 2021, highly skilled workers who can achieve the required level of points may enter the U.K. without a job offer if they are endorsed by a recognized U.K. body.
Employers do not need to be a licensed visa sponsor to employ a foreign national under the global talent scheme.

Penalties —
Employers found to have employed someone they knew or had ‘reasonable cause to believe” did not have the right to work in the U.K. can be subject to five years’ imprisonment and/or an unlimited fine.

可能會被判處五年監禁和/或無限制罰款。
